This study in moral, political, and legal philosophy contends that it is morally impermissible to circumcise male minors without a medical indication (nontherapeutic circumcision). Male minors have a moral anticipatory autonomy right-in-trust not to be circumcised. This right depends on norms of autonomy and bodily integrity. These norms generate three direct non-consequentialist arguments against nontherapeutic circumcision: (1) the loss of nonrenewable functional tissue, (2) genital salience, and (3) limits on a parental right to permanently modify their sons' bodies. An indirect (...) argument holds (4) that if it is morally impermissible to remove the female prepuce (clitoral hood), then it is also morally impermissible to remove the male prepuce (foreskin). Although there is debate across medical cultures, a reasonable understanding supports the claim that nontherapeutic circumcision causes some harms and imposes unwarranted risks on male minors. The overall moral case applies to secular circumcisions and, with some qualifications, to religious circumcisions in Judaism and Islam. Arguments of political philosophy that invoke the freedom of religion, toleration, multiculturalism, and social meaning qualify somewhat, but do not eliminate, the case against circumcising male minors without a medical indication. Nevertheless, the arguments deployed in this study do not warrant legal interference at this time with secular and religious practices of nontherapeutic circumcision. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:Masao Abe and the Dialogue BreakthroughStephen RoweI am profoundly grateful to Masao Abe for many reasons, including his articulation of Zen and his responsiveness to my own work, but most especially for his breakthrough work on dialogue. For he, along with his Christian partner in dialogue, John B. Cobb Jr., has taken us to a new paradigm, one in which dialogue, in complementary relationship with our more particular practices (...) and traditions, can be valued as a religious practice.1 Together these two towering figures of our time have broken through the koan of abstracted universality versus incommensurable particularity, and hence opened up a possibility for the human future the significance of which cannot be overestimated.In October 1986, I had the good fortune to find myself at the Third North American Buddhist-Christian Theological Encounter, the stated theme of which was “Notions of Ultimate Reality in Buddhism and Christianity.” A critical tension was evident early on in this event. Masao Abe spoke very persuasively of the “perspec-tiveless perspective” of Zen, arising from the experience of sunyata as the negation of negation or the radicalizing of Nothingness, of Zen as the affirmation of radical return. John Cobb spoke with equal persuasiveness of our inescapable particularity as historical beings, our ineluctable locatedness, and the irreducible wisdom of Israel and Greece. Both of these opposing views seemed right. How could this be so?To heighten the juxtaposition, it was equally evident that there were three large propositions on which Abe and Cobb very much agreed: first, our need of transformation; second, that this must be mutual transformation; and, third, that transformation must be in the direction of a new universality of humankind, which Cobb describes as “a global memory.” 2 How is it possible for these powerful elements of agreement to be juxtaposed with the critical tension mentioned above? Cobb and Abe, not surprisingly, have their own responses to this question,3 and we can learn from what Abe says about universality and transformation, and how his understanding of both leads him to a specifically religious valuing of the dialogical encounter with the difference that is presented by Cobb.In the paper Masao Abe presented at the 1986 event, he proposed two crucial aspects of dialogue between world religions: (1) seeking clarification of the views peculiar to one’s own tradition through allowing the different views between traditions [End Page 123] to confront one another, and (2) being “free from the peculiarity of our own traditions in order to scrutinize the notion of ultimate reality itself most fitting to our contemporary human predicament and the future of humanity.” 4 The second aspect needs to involve “a very creative and penetrating discussion in which we must be radically critical of our own tradition so that we can re-examine and regrasp the essence of our religion from the more universal and more fundamental position,” and hence “find out the truly ultimate reality for the future of humanity.” 5There is a paradox here: Abe indicates both a more universal orientation and a reappropriation of the essence of our particular traditions. The key to movement beyond paradox as frustrating antinomy to paradox as gateway to vitality is the dialogical practice, and specifically dialogue in its association with mutual transformation and the emergence of a new universality of humankind. For Abe, this turns on the understanding of “universal”:To become a “universal” world religion does not imply a monolithic religion common to East and West, but rather calls for a dynamic structure capable of freely assuming any form, oriental or occidental, according to the area in which it develops and yet without being confined to any limitation of that area. Such a dynamic realization of the “universal” world religion may become possible for Christianity and Buddhism should they genuinely regrasp their respective notions of universal salvation for all mankind.6Dialogue as locus of “dynamic realization” makes possible a new universality, which, for Abe, is based on the self-negation that leads to the awakening of the “true Self,” and “enter[ing] the third historical age of mankind, namely the age of Self-awakened cosmology.” Because “true investigation of the self is always... Stephen RAPP (R.) has embarked on a very ambitious project – to investigate Georgian cultural contacts with the Byzantine and Iranian worlds through Georgian historial writing from its beginnings to medieval times. This involves nothing less than a presentation in English of all the relevant texts, save where a recent translation has already made them accessible, a survey of modern scholarship in Georgian as well as western languages, and a critical assessment of the dates of composition of the various (...) works, their motivation and reception. The volume under review is the first of a planned trilogy. Based on research dating back over a decade, it concentrates on those texts in the Georgian “Chronicles” which predate the political unification of the country. The second volume will tackle the literary dimension of Georgia's conversion to Christianity, the invention of a native script, and the beginnings of ecclesiastical literature; while the third volume will study the reorientation of the Georgian élite from their original Iranian background towards the Byzantine world as this is reflected in local historiography. All in all, this massive undertaking will update, expand and carry forward the work of Cyril TOUMANOFF reflected in his Studies in Christian Caucasian History, which was published exactly forty years before R.'s first volume appeared. The book provides case studies culled from the experiences of the authors throughout their careers in the practice of medical ethics. Perhaps even more useful, however, are the other exercises in which readers are given the opportunity to actively engage the text in order to discover and more fully articulate their own moral stance. Although Health Care Ethics approaches the topic from a theological perspective, using scriptural passages as well as broader religious themes and contexts, the book is accessible to those outside of the religious arena as well.The first three chapters lay the framework for general theological and ethical inquiry while the later chapters discuss more specific topics in applied health care ethics. The opening chapters by Michael Panicola are thought-provoking, especially since they encourage readers to participate in exercises to determine how they would respond to particular scenarios in their personal decision making. For example, after laying out the classic ethical theories, readers are asked to take a “quiz” by responding to multiple-choice questions to determine how they would respond to various ethical situations. The exercise demonstrates that moral discernment that relies on one ethical theory alone or one single approach to ethics is too narrow and confining for authentic dialogue in ethics. Another exercise calls upon readers to examine their fundamental bases for personal decision making by asking them to create a list of what they think are the ten things that constitute human flourishing and then narrow that list down to the top two. In addition to being engaging, these exercises help readers establish their personal moral stance by asking them to appropriate foundational norms in the process of moral discernment to the case studies throughout the book. They also help readers apply these norms to the specific topics in health care ethics presented in the later chapters.The authors of Health Care Ethics clearly identify human flourishing as the center and goal for all ethical inquiry. Aboutness has been studied from any number of angles. Brentano made it the defining feature of the mental. Phenomenologists try to pin down the aboutness-features of particular mental states. Materialists sometimes claim to have grounded aboutness in natural regularities. Attempts have even been made, in library science and information theory, to operationalize the notion. But it has played no real role in philosophical semantics. This is surprising; sentences have aboutness-properties if anything does. Aboutness is the first book to examine through (...) a philosophical lens the role of subject matter in meaning. A long-standing tradition sees meaning as truth-conditions, to be specified by listing the scenarios in which a sentence is true. Nothing is said about the principle of selection--about what in a scenario gets it onto the list. Subject matter is the missing link here. A sentence is true because of how matters stand where its subject matter is concerned. Stephen Yablo maintains that this is not just a feature of subject matter, but its essence. One indicates what a sentence is about by mapping out logical space according to its changing ways of being true or false. The notion of content that results--directed content--is brought to bear on a range of philosophical topics, including ontology, verisimilitude, knowledge, loose talk, assertive content, and philosophical methodology. Institutional talk, including service encounter discourse, has typically been taken to be ‘asymmetrical’ and the participants of these encounters to be constrained in terms of their allowable conversational contributions. This article explores shifts of alignment from normative serverclient alignments into different directions, involving symmetrical positionings of various kinds in travel agency spoken discourse. It is shown how these shifts occur and at which points in the interaction they might be found. The relevance of the commercial institutional context is also considered. (...) It is argued that these shifts from the supposedly unmarked asymmetrical alignment are motivated by orientations to relational goals and politeness/facework concerns, and they function as interpersonal devices achieving various relational configurations. This chapter defends the property dualism argument. The term “semantic premise” mentioned is used to refers to an assumption identified by Brian Loar that antiphysicalist arguments, such as the property dualism argument, tacitly assume that a statement of property identity that links conceptually independent concepts is true only if at least one concept picks out the property it refers to by connoting a contingent property of that property. It is argued that, the property that does the work in explaining the (...) possibility of a posteriori identities need not be a first-order property of the referent in question. On his view, the property dualism argument requires only a weaker semantic premise, which allows that the property in question be a higher order property. A refined version of the property dualism argument is formulated, which uses the weaker premise, and defends the argument against various objections. (shrink)
